Description Anderson will review the legal issues surrounding Indian water rights. Indian reserved water rights are based on federal law. State water rights in the west are based on the "prior appropriation" doctrine. Anderson will provide examples of litigation due to open-ended decrees (lack of certainty), allotment water rights, and extensive non-Indian development. He will also review several settlements.
